Why you need to think carefully about your business or company name.
Just think about this ..
All those hours, days and months of inspiration, of formulating a great business opportunity, the planning, the thorough research, not forgetting the taxation requirements, and on and on. And somewhere in amongst all that you must register the business name with the state Business Names Office with the ultimate beliefthat once registered, no one can take it away from you.
Then, after all that hard work, and totally unforeseen, another business or company owner who happens to be using a word, or symbol which is the same or similar to the one within your business name, could send you a "cease and desist" letter demanding you to stop using their trade mark as your business name. If I asked you to think of a company that makes swimwear, the word SPEEDO® may come to mind. Now, the owner of that trademark or brand name, is Speedo Holdings BV (a Dutch company) who owns and registered the trade mark SPEEDO® in Australia (and elsewhere). Although it forms part of the company name, it is only the word "speedo" which is used in connection with clothing and thus distinguishes the clothing from other clothing in the marketplace. Basically, this is the difference between a business/company name and a trade mark.
In other words, although the Business Names Office would allow another similar name, such as, SPEADO Holdings, to be registered as a business name, the Trade Marks Office at IP Australia would not allow the same or similar word such as SPEADO to be registered as a trade mark and used in connection with clothing. This is because is clearly deceptively similar to the registered trade mark, SPEEDO® - meaning that it sounds the same and thus would cause confusion in the marketplace.
